If the parties cannot agree on an arbitrator, one shall be appointed by the Chairperson of the Chartered Institute of Arbitrators, Kenya Chapter. The arbitration shall take place in Nairobi, Kenya, and the proceedings shall be conducted in English.

The decision of the arbitrator shall be final and binding on both parties. Each party shall bear its own costs of arbitration unless otherwise determined by the arbitrator.

Nothing in this section shall prevent either party from seeking interim or injunctive relief in a court of competent jurisdiction where necessary to protect its rights pending the outcome of arbitration.

These T&Cs and any disputes arising out of or in connection with your use of the website shall be governed by and construed in accordance with the laws of Kenya. Any legal proceedings arising out of or relating to these T&Cs shall be brought exclusively in the courts of Nairobi, Kenya.
